CUSTOMS and BORDER PROTECTION (CBP)

Electrode Steam Humidifier - CBP is proposing to change the classification of certain humidifiers which produce steam by an electric current generated between electrodes immersed in water from HTSUS 8543.89.96 (2.6% duty), the provision for other electrical machines and apparatus; the proposed classification is under HTSUS 8543.80.75 (duty free), the provision for "other electrical machines…."

Short-Sleeved Batting Jacket – CBP is proposing to classify a men’s nylon pullover shirt with a partial front opening with two snap closures, short hemmed sleeves, rib knit inserts at the armholes, and a straight bottom with a draw-cord and cord lock under HTSUS 6211.33.0061 (16% duty, cat. 659). CBP notes that the garment is considered as a "sports" article used primarily during play of a certain sport, as is not considered as a regular shirt under HTSUS 6205.30.2070 (29.1¢/kg. + 25.9% duty, cat. 640).

TRADE TALK

AGOA – The USTR recently submitted to the U.S. Congress its annual report on the progress of the African Growth and Opportunity Act (AGOA) noting that bilateral trade has more than doubled since AGOA’s inception in 2000. Also noted was the fact that thirty seven (37) of the forty eight (48) sub-Saharan countries are now eligible for AGOA benefits. The U.S. is also seeking eligible AGOA countries to make increased use of their trade opportunities and will negotiate bilateral investment treaties (BIT).

Rwanda The U.S. and Rwanda recently signed a Trade and Investment Framework Agreement (TIFA) to enhance bilateral trade and mature Rwanda’s trade environment.

Diamond Sawblades – Made a final affirmative determination in its antidumping (AD) investigation of certain diamond sawblades and parts thereof from China (2.50% -164.09%) and Korea (6.43% - 26.55%).

Oil Country Tubular Goods – Initiated a five-year Sunset Review of its AD order of certain oil country tubular goods from Argentina, Italy, Japan, South Korea, and Mexico, and its countervailing duty (CVD) order on the same product from Italy.

Pressure Pipes – Initiated five-year Sunset Reviews on its AD order on certain seamless carbon and alloy steel standard, line, and pressure pipes from Argentina, Brazil, and Germany.

Steel Bar – Determined to conduct full Sunset Reviews of its AD order on certain steel pipes from Brazil, India, Japan, and Spain.

BUSINESS BRIEFS

High-Tech Exports to China – The U.S. Bureau of Industry and Security (BIS) is preparing to propose new regulations to govern the sale of high technology goods to China. The BIS is seeking to develop a two-pronged approach whereby up to forty (40) additional items not currently under control will be added to the control list requiring an export license while reducing the licensing burden on other articles. Particularly, the BIS will allow certain controlled goods to be sold to Chinese enterprises which have no relationship to the Chinese military and whose record demonstrates their adherence to U.S. export guidelines. The new guidelines are expected to be announced shortly.

IPR – The EU’s trade chief warned China of a trade backlash if it doesn’t improve protection for intellectual property rights (IPR).

Anti-Monopoly Legislation – China issued draft anti-monopoly legislation to ban monopolistic agreements such as price fixing and other forms of collusion. The draft legislation defines a monopoly as a single company controlling 50% or more of a market, two companies controlling two-thirds of a market, or three companies controlling 75% or more of a market. While foreign investors, particularly in the auto, electronics, and chemical fields are worried that the new law will be used to restrict foreign investment, China is adamant that the law is intended to level the playing field for domestic and foreign companies alike.
