CUSTOMS and BORDER PROTECTION (CBP)

 

1) Stainless Steel Measuring Cups – CBP is proposing to reclassify certain graduating stainless steel measuring spoons from subheading 8215.99.3000 (14% duty), HTSUS, the provision for "Spoons…Other:... valued under 25¢ each"; as the principal use of the measuring spoons is for kitchen use as capacity measures, they are more properly classified under subheading 7323.99.9030 (3.4% duty), HTSUS, the provision for "Table, kitchen, or other household articles…Kitchen or tableware suitable for food or drink contact."

2) 40" LCD Monitors – CBP is proposing to reclassify a 40" LCD monitor, which does not have a television tuner or the ability to decode video signals, from subheading 8528.12.7201(5% duty), HTSUS, the provision for "Reception apparatus for television: Color…Other: Other"; although an audio/video card can be attached for video viewing, the monitors are more properly classified under subheading 8528.21.7001 (5% duty), HTSUS, the provision for "Reception apparatus for television: Video monitors: Color: Other: Other."

3) CD Softcase with Loudspeaker – CBP is proposing to reclassify a softcase used to store several compact disks which encompass an integrated loudspeaker under subheading 4202.92.9050 (17.6% duty), HTSUS, the provision for "Trunks… Other…Other: Cases designed to protect and transport compact disks…"; although the case encompasses a loudspeaker which amplifies music (subheading 8518.21.0000, 4.9% duty, HTSUS), the essential character of the case is its ability to "protect and store" compact disks during travel.

TRADE TALK

1) UAE – Free trade talks between the U.S. and the United Arab Emirates resumed on May 9, 2006.

2) South East Europe – The EU recently launched talks for a regional FTA encompassing the South East European nations of Albania, Bosnia-Herzegovina, Bulgaria, Croatia, Kosovo, Macedonia, Moldova, Romania, and Serbia and Montenegro. The proposed FTA will replace the 31 different bilateral agreements currently in place between the countries.

3) Asian Free Trade Area – Leaders of India and Japan recently called for the eventual creation of an Asian-wide free trade area to encompass all the major Asian economies, and possibly extending to Australia and New Zealand.

4) Uruguay – Uruguay and the U.S. recently agreed to strengthen bilateral economic ties, which may eventually lead to a bilateral FTA.

5) Singapore and Pakistan – Singapore and Pakistan recently concluded their third round of negotiations toward a FTA. Singapore has ongoing FTA negotiations with Bahrain, Canada, Egypt, Mexico, and Sri Lanka.

6) Bangladesh & Pakistan – Bangladesh and Pakistan agreed to sign a bilateral FTA.

7) Israel – Israel is negotiating a FTA with the Mercosur bloc of nations (Argentina, Brazil, Paraguay, and Uruguay) with an eye to completing negotiations by July 2006.

    1. Decided to keep in place its antidumping (AD) order on certain large diameter carbon and alloy seamless standard line and pressure pipes from Japan as well as keeping the AD order on the same product in small diameter from Japan and Romania.
    2. Scheduled a Sunset review of its AD order on certain helical spring lock washers from China and Taiwan.
    3. Scheduled a Sunset review of its AD order on silicon metal from Brazil and China.

BUSINESS BRIEFS

China Unexpectedly Raises Interest Rates – In an effort to head off an overheating economy, China unexpectedly raised the interest rates it charges banks by 27 basis points. Eschewing its past reliance on various administrative remedies, China chose this time to use a market-based tool to try and arrest the economy’s runaway growth. The U.S. Government and business analysts applauded the move as it indicates that China may be choosing a greater reliance on market-driven solutions to economic problems, which may eventually lead it to allow its currency greater market flexibility. In taking into account this interest rate increase and the recent announcement that it will allow companies and individuals to invest in overseas stocks and bonds, economists believe China will eventually follow with the U.S.’ most desired action to cool its economy, allowing the Yuan to rise against the U.S. dollar. In addition, senior Chinese officials haven’t ruled out another interest rate increase soon as an indication that it is seeking to be seen as using more marked-based solutions in managing their economy.

Chemical Industry – 1) Two international companies agreed to pay civil penalties totaling over $72 million and agreed to assist a U.S. Department of Justice investigation into price fixing in the hydrogen peroxide and sodium perborate industries; 2) France’s antitrust authority fined several leading perfume and cosmetic companies for colluding to fix distributor’s margins and prices;

Pharmaceutical Industry – 1) Britain’s Serious Fraud Office announced criminal proceedings of various companies and individuals resulting from its investigation of certain price fixing practices in the generic pharmaceutical industry; 2) while the EU’s Court of First Instance recently reduced the fines of two participants of the EU’s largest price fixing investigation for technical reasons, it rejected the companies attempts to annul the original punishment. The case involved several international companies and the price fixing in the vitamin industry, resulting in fines totaling more than $1 billion.
