CUSTOMS and BORDER PROTECTION (CBP)
1) Steel Tubes for Fence Posts – CBP is reclassifying certain galvanized steel tubes which are swaged at the ends and used as fence posts and in other structures from the current classification in subheading 7326.90.8587 (2.9% duty), HTSUS, the provision for "other articles of iron or steel"; as the posts are used in railings, fencing, and other structures, they are classified under subheading 7308.90.9590 (duty free), HTSUS.
2) Leather Card Case with Money Clip and Watch: CBP is classifying a leather card case with a removable money clip sporting a built in watch as a "set" under subheading 4202.31.6000 (8% duty), HTSUS, as the essential character is provided by the card case.
3) Stainless Steel Pipe Fitting System (Nuts) – CBP is reaffirming its previous classification of certain pipe fitting tubes (nuts) specifically designed and marketed for use in plumbing systems under subheading 7307.29.0090 (5% duty), HTSUS, the provision for "Tube or pipe fittings…Other…Other, Other." Although they are sometimes referred to as "nuts", "pipe fitting nuts" and "common nuts" are designed, function, and marketed in different ways and are not interchangeable.
4) Unworked Glass Rods for Optic Fibers – Glass rods used to create optic fibers are first turned into "performs" and subsequently turned into optical fibers. As several processes are required prior to the rods becoming "performs", they are still in an "unworked" state when imported, therefore, they are not classified as "other articles of glass" under subheading 7020.00.6000 (5% duty), HTSUS, but rather, are more properly classified under subheading 7002.20.1000 (duty free), HTSUS, as "unworked glass in rods of fused quartz or other fused silica."
5) Plastic Beaded Flower Bracelet, Necklace - A plastic beaded bracelet or necklace with a threaded ribbon is imported for use by florists to create fresh flower corsages. Although they can be subsequently used for a multitude of purposes, including their use as imitation jewelry articles, because at the time of importation they were destined for use as flower corsages, they are not to be classified as "imitation jewelry" under subheading 7117, but rather, under subheading 3926.90.3500 (6.5% duty), HTSUS, as "Other articles of plastic…Beads, bugles and spangles…Other."
TRADE TALK
Vietnam – The U.S. and Vietnam are expected to sign a bilateral trade agreement during the Asia-Pacific Economic Cooperation forum set for Ho Chi Minh City for June 1-2, 2006. The agreement is the last major obstacle in Vietnam’s quest to join the World Trade Organization (WTO). Besides lower bilateral duties, Vietnam agreed to cease to subsidize its textile industry and the U.S will lift textile quotas on exports from Vietnam. However, the U.S. Congress must grant Vietnam permanent normal trade relations (PNTR) before it can join the WTO.
Oman – The U.S. House of Representatives’ House Ways & Means Committee approved draft legislation to implement the U.S.-Oman Free Trade Agreement (FTA). The full House and U.S. Senate must approve the legislation before it can be sent to the president for his signature.
Ecuador – Reports indicate that the U.S. suspended free trade talks with Ecuador after it appropriated assets belonging to a U.S. company.
Chad – Effective April 26, 2006, eligible textile and apparel imports from Chad qualify for preferential treatment under the African Growth and Opportunity Act (AGOA).

Removal of Duty Exemptions – India is seeking comments by June 10, 2006 on its proposal to withdraw customs and excise duty exemptions on certain goods, e.g., chemicals, electronics, toys, plastics, tableware, bicycle and related products, stoneware, and certain metals. Focus on Export Growth Announced – In an effort to boost exports, India announced a new focus on export growth and employment through promotion of manufacture and the exportation of certain industries, e.g., jewelry and automotive. Details on benefits to be granted, including a reduction of value added taxes, can be accessed at:

Some of the changes include: ability to perform all patent activities at all patent offices, i.e., Chennai, Delhi, Kolkata, and Mumbai; the mandatory publishing of all patent applications within 18 months; referral to an examiner within one month of a request; and extension of time for asking for examination, pre-grant opposition, and reply to opposition.
