CUSTOMS and BORDER PROTECTION (CBP)

 

NAFTA Eligibility of Wire HarnessesCBP is proposing to modify its previous position regarding the NAFTA eligibility of certain wire harnesses, in particular the tariff-shift requirement for eligibility. CBP previously allowed NAFTA claims if there was a tariff-shift for non-originating materials either to heading 8544.11 through 8544.60 from among those headings or from headings 7408, 7413, 7605, or 7614, provided the regional value content (RVC) is met. However, CBP is now proposing that any tariff shift to headings 8544.11 through 8544.60 is valid only if there was also a tariff-shift from headings 7408, 7413, 7605, or 7614, and the product must also have a RVC of at least 60% when using the transaction value method or 50% when using the net cost method.

Ceiling Mounted Hospital Platforms Ceiling mounted platforms for operating or recovery room equipment are not to be classified as parts and accessories to medical apparatus of HTSUS 9033.00.00 (4.4% duty); proper classification is under HTSUS 9402.90.0020 (duty free), the provision for "Medical furniture…: Other: Other."

TRADE TALK

MalaysiaFollowing the first round of free trade negotiations between the U.S. and Malaysia, the U.S. Trade Representative (USTR) noted that the parties are well positioned to conclude negotiations by the end of this year.

Jordan Valley FTZ Leaders from Israel, Jordan, and the Palestinian Authority recently agreed to promote the establishment of a free trade zone (FTZ) in the Jordan Valley.

China-South Africa Textile Agreement China and South Africa recently signed a trade agreement capping Chinese textile exports to South Africa.

Polyester Staple FiberThe U.S. International Trade Commission (ITC) instituted a preliminary phase antidumping (AD) investigation of polyester staple fiber from China.

Stainless Steel Angle – Following a Sunset Review, the AD order on stainless steel angle from Japan, South Korea, and Spain will be revoked.

Cement – Decided to keep in place the AD order on gray portland cement and clinker from Japan.

Diamond Sawblades – While the U.S. International Trade Administration (ITA) found that a domestic industry was being injured by imports of diamond sawblades and parts thereof from China and Korea, the ITC determined that no domestic industry is being injured, resulting in no AD order being issued.

BUSINESS BRIEFS

Countervailing Duties – The U.S. Government Accountability Office (GAO) recently released a study on the effect of applying countervailing duties (CVD) on goods from China. The study describes options for applying CVD’s, the challenges that would arise, and examines the likely results on Chinese products. The study is available at: http://www.gao.gov/new.items/d06608t.pdf.

IPR Issues – The USTR is seeking is seeking comments by July 14, 2006 with regard to its investigation of China’s intellectual property rights (IPR) protection.

Petition on Labor Practices – The AFL-CIO union recently filed a Section 301 petition asking the President to impose trade sanctions on China over its dismal labor practices. The same petition was filed two years ago and was rejected by the U.S. administration.

China – The U.S. Patent Office (USPTO) and its Chinese counterpart recently completed a program on the protection of geographical indicators (GI). While the U.S. protects GI’s under its regular patent procedures, China on the other hand grants protection for GI’s under its regular patent program as well as under a separate government program, which has sometimes led to confusion.

Japan – The USPTO and Japan’s Patent Office will launch the Patent Prosecution Highway (PPH), which is intended to speed review of patent applications and eliminate duplication and redundancies. Under the pilot program, when a patent is filed in one country after being filed in the other, the second country will be able to avail themselves of the patent search results of the other country in order to eliminate any redundant searches.
