Canadian Softwood Lumber Duties Deemed Unlawful

The US Court of International Trade issued a July 21 ruling declaring the United States has no basis under United States law to impose duties on Canadian softwood lumber. The court's judgment implies the countervailing and anti-dumping duties should never have been imposed and cannot be legally maintained going forward. As a result of the decision, the United States will be obligated to return all of the deposits collected since November 4, 2004, plus interest. United States industry disagrees with the court's decision and plans to appeal the ruling.
