CPSC Rules Certain Materi= al Exempt from Lead Testing Requirement

On August 18^th, 2009, the Consumer Product = Safety Commission (CPSC) released a final rule listing children’s products t= hat are exempt from the lead testing requirement outlined in the Consumer Produ= ct Safety Investment Act (CPSIA). The CPSC ruled that some products no longer require testing because, by their nature, they do not contain lead in excess of the limits set in Section 101= of the CPSIA. Although these pro= ducts do not require lead testing, they must still meet the applicable lead limits set forth in the CPSIA. Below= is a partial list of products that no longer require lead te= sting:

·  &n= bsp;            = Textiles (excluding after-treatment applications, including screen prints, transfers, decals, or other prints) consisting of:

o      =        = Natural fibers (dyed or undyed) including, but not limi= ted to, cotton, kapok, flax, linen, jute, ramie, hemp, ken= af, bamboo, coir, sisal, silk, wool (sheep), alpaca, llama, goat (mohair, cashmere), rabbit (angora), camel, horse, yak, vicuna, qiviut, guanaco;

o      =        = Manufactured fibers (dyed or undyed) including, but not limi= ted to, rayon, azlon, lyocell<= /span>, acetate, triacetate, rubber, polyester, olefin, nylon, acrylic, modacrylic, aramid, spand= ex.

·  &n= bsp;            = Other plant-derived and animal-derived materials including, but not limited to, animal glue, bee's wax, seeds, nut shells, flowers, bone, sea shell, coral, amber, feathers, fur, leather.

·  &n= bsp;            = Wood; paper and similar materials made from wood or other ce= llulosic fiber, including, but not limited to, paperboard, linerboard and medium, and coatings on such paper which become part of the substrate.

·  &n= bsp;            = CMYK process printing inks (excluding spot colors, other inks that are not used = in CMYK process, inks that do not become part of the substrate under 16 CFR pa= rt 1303, and inks used in after-treatment applications, including screen print= s, transfers, decals, or other prints)

·  &n= bsp;            = Precious gemstones: diamond, ruby, sapphire, or emerald. Semiprecious gemstones and other minerals, provided that the mineral or material is not based on lead or lead compounds and is not associated in nature with any mineral based on lead or lead compounds (excluding any mineral that is based on lead or lead compoun= ds including, but not limited to, the following: aragonite, bayldonite, boleite, cerussite,= crocoite, galena, mimetite, phosgenite, vanadinite, a= nd wulfenite). Natural or cultur= ed pearls

·  &n= bsp;            = Surgical steel and other stainless steel within the designations of Unified Numbering System, UNS S13800 S66286, not including the stainless steel designated as 303Pb (UNS S30360)

·  &n= bsp;            = Precious metals: gold (at least 10 karat); sterling silver (at least 925/1000); platinum; palladium; rhodium; osmium; iridium; ruthenium, titanium—provided that no lead or lead-containing metal is intentiona= lly added but does not include the non-steel or non-precious metal components o= f a product, such as solder or base metals in electroplate, clad, or fill applications.
