Countdown to ISF Enforcement =

The enforcement perio= d for US Customs and Border Protection’s (CBP) Importer Security Filing (ISF, = also called 10+2) begins January 26, 2010. Trade officials warn that failure to comply with the regulations cou= ld prove detrimental to business, directly impacting importer of records’ bottom-lines. Research indica= tes the new regulations will add more than two days delay to ocean shipments. Moreover, there are penalties for incomplete, inaccurate or late filings.&nb= sp; For each incomplete, inaccurate, or late ISF filing, CBP may impose a fine of $5,000 and up to $10,000 per filing for subsequent infractions. These violations are a concern to importers, more than half of whom still have trouble filing ISF data on time and who struggle with filing complete and accurate data. Initially, CBP will focus its enforcement efforts on those importers who have made no attempt to file ISF data during the phase-in period. Leniency will be granted to those importers who were already filing ISF data in 2009= , as CBP has indicated that in cases where the importer of record has exhibited = due diligence there will be a greater likelihood for penalty mitigation.
