The United States Trade Representative has published the first list of goods excluded from the 25 percent duty assessed under the second tranche of the Section 301 tariffs on China. These exclusions are “reflected in 69 specially prepared product descriptions, which cover 292 separate exclusion requests.” The exclusions apply to those goods meeting the product descriptions, regardless of which importer submitted the exclusion requests.
Goods included on the list are primarily from chapters 39, 84, 85, and 90, as well as two product descriptions from chapters 86 and 87. The exclusions will have a backdated effective date of August 23, 2018, and will expire one year after the date of the notice. The scope of the exclusions is governed by the product description published in the Annex, not the product description found in the exclusion requests.
