The US Trade Representative (USTR) has issued new exclusions for goods on the first three Section 301 lists. Exclusions on the first tranche include “310 specially prepared production descriptions, which covers 724 separate exclusion requests.” The second tranche exclusions cover 89 product descriptions from 400 exclusion requests, and the third tranche exclusions cover 28 product descriptions from 46 requests.
The product exclusions will apply retroactively to when each list became effective. The first tranche is retroactive to July 6, 2018, the second tranche to August 23, 2018, and the third tranche on September 24, 2018. Chinese-origin goods on lists one and two will be safe from the 25 percent duty for one-year from publication in the Federal Register, while the exclusion for goods on list three will expire on August 7, 2020.
