On March 28, 2022, the U.S. Trade Representative (USTR) published the Federal Register (FR) notification that it would reinstate certain Section 301 exclusions retroactively to October 12, 2021. In many cases, the reinstated exclusions are product specific and depend upon the HTSUS Classification of goods as entered and the product description. Some exclusions include an entire tariff classification.
Importers are encouraged to review the notice to determine if their products are included in the listed HTSUS numbers and match the description stated in the posted FR notice. Deringer can assist companies in ascertaining whether they may have imported goods potentially subject to the exclusions during the applicable timeframe.
