CBP is continuing its focus on ensuring that the de minimis Section 321 (not exceeding $800 per day) is enforced. On January 11, 2025, U.S. Customs and Border Protection (CBP) will roll out the second phase of the Section 321 enhancement for shipments not exceeding $800 in the Automated Commercial Environment (ACE). This update will introduce a warning in ACE when a de minimis shipment might surpass the $800 per person/per day limit. Additionally, this release will affect electronic data interchange (EDI) processes. In short, If this warning is received, it’s possible that when the shipment arrives at the border, it could be held, and a demand for an entry type 01 or 11 may be required because CBP has determined that the $800 per day has been exceeded.
