Over the past week, the Office of the US Trade Representative (USTR) announced new product exclusions and exclusion amendments from the Section 301 tariffs on imports from China.
On May 4th, the USTR published new products excluded from the $200 billion trade action (List 3). The specific products are listed in the Federal Register notice and include “two 10-digit HTSUS subheadings, which cover 15 separate exclusion requests, and 144 specially prepared product descriptions, which cover 170 separate exclusion requests.” These exclusions are retroactive to September 24, 2018, and are valid until August 7, 2020. The products were varied, ranging from powdered free-dried pumpkins to reversing valves for heat pumps to kitchen hand tools and will use the new subheading of 9903.88.46.
A few days later, on May 8th, the USTR published additional exclusions from the $300 billion trade action (List 4), as well as List 1 exclusion amendments and List 2 exclusion amendments. The new List 4 exclusions include “three 10-digit HTSUS subheadings and five specially prepared product descriptions, which together respond to 27 separate exclusion requests.” This set of exclusions includes tumblers used in healthcare facilities, medical bracelets, Bluetooth tracking devices, and other products, which are retroactively excluded to September 1, 2019, and in effect through September 1, 2020.
