U.S. Customs and Border Protection (CBP) issued CSMS #52344962 on July 1, 2022, indicating that AMS and CBP were fixing an issue in the AMS logic in ACE that affects the HTS filings of potatoes for various Marketing Order (MO) message sets. As a temporary fix, the severity for the following HTS Codes will be temporarily changed from a rejection to a warning:
- 0701.90.5005
- 0701.90.5017
- 0701.90.5021
- 0701.90.5040
You should not submit any AMS data for these HTS codes during this time. A warning will generate, but the entry will be accepted. Importers are still required to ensure compliance with potato Section 8e import inspection requirements. All other HTS codes subject to AMS Marketing Order filing requirements must still submit the AMS data. Once the issue has been corrected, AMS will send another CSMS message.
