Final Countervailing Duty Rates Set for 2023
The U.S. Department of Commerce (DOC) recently released its final determination for the sixth administrative review of the countervailing duty order on certain softwood lumber products from Canada. Administrative reviews are conducted once a year at the request of an interested party after an antidumping or countervailing duty order is put into effect. This review covers imports of softwood lumber products from Canada that entered into the United States during the period of January 1, 2023, to December 31, 2023.
The DOC has determined that producers and exporters of softwood lumber products from Canada received countervailable subsidies at subsidy rates ranging from 12.12 percent to 16.82 percent. The final subsidy rate for non-selected companies listed in Appendix II, which applies to most Canadian companies, has been determined to be 14.63 percent, up from 6.74 percent determined in the previous administrative review. The final rate for all non-reviewed companies will be the most recent company-specific or all-others rate applicable to the company.
The DOC will instruct CBP to liquidate all entries of subject merchandise that entered the United States during the review period and assess duties at the final rates no earlier than 41 days after the final results are published in the Federal Register.
The duty rates determined in this final administrative review will apply to all entries of subject merchandise entered, or withdrawn from warehouse, for consumption on or after August 12, 2025, for the selected and non-selected companies.
