An interactive tool is available on the U.S. Customs and Border Protection (CBP) website, which allows users to easily filter and view data from the Enforce and Protect Act (EAPA) investigations.
According to CBP’s statement, the Enforce and Protect Act (EAPA) authorizes U.S. Customs and Border Protection (CBP) to examine “whether an entity has evaded antidumping and countervailing (AD/CVD) duties in an on-the-record investigation. EAPA is a multi-party, transparent, administrative proceeding,” Parties involved in the investigation have the option to seek administrative and judicial reviews of CBP’s evasion determination should they decide to appeal. On February 24, 2016, the Trade Facilitation and Trade Enforcement Act of 2015 (TFTEA) gave authorization to the EAPA program. Then, the CBP implemented EAPA through regulation in August 2016.
The webpage features a color-coded map, which displays the EAPA investigations that have made it to the interim measures and/or determination as to evasion stages of an investigation. As stated by the CBP, “EAPA investigators have investigated claims of evasion involving multiple products, including steel wire hangers, steel pipe and pipe products, wooden bedroom furniture, thermal paper, chassis, diamond sawblades, glycine, quartz surface products, wooden cabinets and vanities, xanthan gum, hardwood plywood, and aluminum extrusions.”
