On Friday, January 24, 2020, President Trump issued a proclamation expanding Section 232 duties on aluminum and steel to include “derivative” aluminum and steel articles. The addition of the 10% Section 232 duties on aluminum and 25% Section 232 duties on steel will apply to certain “downstream” manufactured articles. These items are described in Annex I (aluminum) and Annex II (steel) to the proclamation, which the USTR has yet to publish. The new duties are effective on or after 12:01 a.m. eastern standard time on February 8, 2020. These rates of duty are in addition to any other duties, fees, exactions, and charges applicable. Imports of derivative aluminum articles from Argentina, Australia, Canada, and Mexico and derivative steel articles from Argentina, Australia, Brazil, Canada, Mexico, and South Korea are not subject to the additional duties.
