On August 6, 2020, the US Trade Representative (USTR) extended certain product exclusions from Section 301 List 3. The extended exclusions cover 21 ten-digit subheadings and 245 product descriptions imported from China, including types of freeze-dried fruit, fabrics and textiles, and pumps. More than 700 exclusions were not included in the USTR notice and expired yesterday. The exclusions were set to expire on August 7, 2020, but will be extended through December 31, 2020.
The USTR also issued a new set of Section 301 product exclusions from List 4. According to the USTR Notice, the exclusions cover “one existing ten-digit HTSUS subheading and 9 specially prepared product descriptions, which together respond to 25 separate exclusion requests.” The exclusions are valid retroactively from September 1, 2019, through September 1, 2020.
Furthermore, US Customs and Border Protection (CBP) recently published CSMS 43531632 and CSMS 43534641 providing guidance on changes to specific Section 301 List 1 and List 2 exclusions, as well as the addition of List 4A (round 8) product exclusions.
