A new round of product exclusions from Section 301 List 4 tariffs on goods originating in China has been published by the US Trade Representative (USTR). The list of “11 existing ten-digit HTSUS subheadings and 53 specially prepared product descriptions” account for 242 separate exclusion requests. The exclusions represent various items from List 4A, such as consumer products, textiles, apparel, some athletic wear and equipment, and certain coins. The products are further described in the USTR publication, which specifies that the subheading of 9903.88.53 will be used for these new exclusions.
The effective date is retroactive to September 1, 2019, and extends to September 1, 2020. Importers should seek refunds on Section 301 duties paid since September 1, 2019. Additionally, the USTR is accepting comments “on the possible extension of particular exclusions” via the USTR Comments Portal; comments must be submitted by August 14, 2020, at 11:59 pm ET.
