New mandatory data reporting requirements for imports of organic products into the United States go into effect on March 19, 2024. Under the USDA Agricultural Marketing Service’s (AMS) Strengthening Organics Enforcement (SOE) Program, foreign exporters of most organic products must obtain an NOP Import Certificate from their local organic certifier.
NOP Import Certificates must be provided to Customs brokers along with the usual clearance documents so brokers can facilitate the transmission of the organic data via U.S. Customs ACE system. In addition, the SOE regulations prescribe that a statement indicating the organic status of products must be made for goods sold or marketed as certified organic. This includes but is not limited to commercial invoice, bill of lading and packing slip. In order to prevent confusion and shipment delays, it is advised that exporters also indicate on their shipment documentation or otherwise provide a statement indicating the status of product being exported as conventionally grown or non-organic.
